Sale Terms and Conditions

General
This Agreement is a legally binding contract between the entity named on the invoice (the Customer) and Modix Sales Australia Pty Ltd trading as Media Players and More ABN 91 122 176 934. Media Players and More agrees to supply the customer goods and/or services subject to the terms and conditions set out in this Agreement.

Acceptance
The receipt of a Customer order by Media Players and More confirms acceptance of these Terms and Conditions of Sale.
Media Players and More reserves the right, without prior notification, to limit the order quantity on any item and/or refuse service to any customer, to supply less than the quantity ordered, to accept or decline your order for any reason and without further explanation.
Your receipt of any form of order confirmation does not constitute the acceptance of an order, nor does it constitute confirmation of our offer to sell. Only when the order is invoiced and despatched it has been accepted by Media Players and More.
Verification of information may be required prior to the acceptance of any order especially in the case of International or Credit Card orders.

Price
All prices are in Australian dollars and are inclusive of GST and exclusive of freight, unless otherwise stated.
Media Players and More reserves the right to alter prices and descriptions at any time without prior notification and are subject to change at any time.
There will be no credit or refund given on the price difference of the ordered items due to price drops once the product has been ordered, regardless if it pending or has been shipped. Prices of computer parts are volatile and we do not control the price fluctuations.

Payment
All orders are to be paid for in full before they can be shipped. This also includes any pre-orders.
All re-orders due daes are subject to change due to shipping delays, customs delays etc. If you cannot accept this then please do not order.
Our payment options are Bank Transfer, Direct Bank Deposit, Cheque, Australia Post Money Order, Visa and Mastercard.
A Non-Refundable deposit is required for all Non-Standard, Non-Stocked or Custom made products before they can be ordered from the Manufacturer or Wholesaler. Generally this amount is 25% of the order total for  Australian orders and 100% for all import orders however Media Players and More reserve the right to alter this based on the individual order. All pre-orders require payment at the time of placing the order unless alternatives have been dicussed and agreeded in writing by Media Players and More.

Delivery
As a Customer order is despatched a shipping confirmation email will be sent advising the date of despatch, the shipping method and any tracking numbers related to the shipment.
If the despatch method is by a Courier and the Courier attempts delivery and there is nobody home to sign for the goods then the Courier may request a re-delivery fee be paid before they redeliver the shipment. Alternatively you may be able to arrange to collect it from their depot and the fee may be waived.
This is a common clause in all Couriers contracts and they have the right to enforce it at their sole discretion. We have no control over this and always recommend delivery where somebody can sign for it during normal Mon-Fri business hours. All pre-order with an expected due date are dates given to Media Players and More by the manufacturer. These dates are subject to change based on the manufacturers manufacturing schedules. The dates are given in good faith based on communication from the manufacturer and knowledge of standard transit times. Media Players and More accepts no liability should a manufacturer alter these dates or delay any pre-orders. Media Players and More will not provide any guarantees to any pre-order dates so we are unable to accept any pre-orders with date stipulations.

Order Cancellation
All order cancellations must be communicated by the Customer by email only.
If you decide to cancel your order after it has been placed we reserve the right to charge you an administration fee. This fee is 10% of the order total or a maximum of $25.00 (whichever is lower) for any items. All non-stocked buy-in products attracts a 10% fee.
This fee is waived if there is stock availability problem to which we have advised you of or if you purchase another item of equivalent or higher value. This fee is not waived should you decide to cancel your pre-order due to any unforseen manufacturers shipping delays.
If your order has been shipped (tracking number advised and/or goods not yet received), we are unable to cancel your order.

Late delivery including delayed manufacturer's ETA's on a pre-order will not be accepted as a reason to cancel your order. If Media Players and More agrees to cancel your order the administration fee is still payable.If your order is urgent please contact us for other delivery options. We may need to choose a more expensive direct courier or arrange some other solution.

Warranty (Australia)
Unless otherwise stated, all products sold have a 1 Year Return to Base Manufacturers Warranty (RTB). This means for any warranty claims you are liable for the cost of returning the product to us and we are liable for the cost of returning the repaired or exchanged product back to you.

Unless imported directly by Media Players and More, all warranty claims are the responsibility of the respective Manufacturer. Customers may be required to contact the manufacturer's technical support department directly to obtain authorisation to return any defective goods to Media Players and More.

Warranty is not transferable and is only applicable and valid for the original purchaser of the item and only applies to the goods sold by Media Players and More. Warranty does not cover any other equipment used in conjunction with the item(s) sold by Media Players and More.

All warranty's are voided if the returned product is found in any way to be mishandled, misinstalled, modified, tampered, abused, physically damaged or used under the wrong voltage.

For products returned that are claimed to be faulty but after inspection are found to be not faulty a fee of up to $50 may be payable by the customer. This is to cover costs in receiving, testing and processing your return. The Customer will also be liable for any shipping and handling costs associated with the return of the non-faulty product. For this reason please ensure the product is actually faulty before lodging a claim

In the event that you receive a product that is not in working order (Dead on Arrival/DOA), please notify Media Players and More within 3 days. Failure to report a DOA item within 3 days will result in you not being able to make a DOA claim. Instead, those items will then follow our normal warranty procedure.

For any DOA product(s) Media Players and More will arrange the replacement (subject to stock availability) at their cost and arrange the return of the DOA product(s).

Our definition of DOA is the unit does not power up when turned on or the unit does not reach the main manu screen when turned on. No other fault is classified as a DOA claim and could possibly be a standard warranty case as deemed by Media Players and More.

Media Players and More will gladly refund or exchange any product that arrives faulty, does not perform as advertised or does not match the description given at the time of purchase.

All media players inevitably have some sort of software bug in them exactly the same as a computers operating system like Windows have. Any software bug that could reasonably be expected to be fixed with an update of the firmware from the manufacturer is not classed as a warranty or refund reason. Likewise incompatibility with codecs is not classed as a warranty or refund reason.

We do not provide advance replacement for any warranty items under any circumstances. Please keep this in mind when you place your order. Media Players and More is not responsible for any losses resulting from the time it takes to have the faulty item replaced or repaired.

If you will be using the item(s) for mission critical tasks, be it running a business, using it to prepare for an examination, using it for a pre-organised activity etc, you should consider purchasing it from a provider that offers instant replacement.

Turnaround time for warranty claims largely depends on the suppliers or distributors. We will try our best to speed up the process. Please understand the time involved for a warranty claim will include:
1) our time to test the item,
2) shipping to the supplier,
3) supplier's own test and
4) replacement/repair,
5) the shipment back to Media Players And More,
6) and finally the shipment to the customer.
On average, the complete warranty turnaround time for most products is 7-10 days however this can take 3-4 weeks for a complex warranty claim.

Warranty (International)
No International Warranty is offered by Media Players and More as we only sell to Australia.

Retention of Title
Media Players and More reserves the title of ownership for any extra or incorrect goods shipped as result of our error. We will arrange any extra shipments to recover these goods, and cover the cost in resolving this issue.

Data Loss
Media Players and More will not be liable in any way for incidental, consequential or indirect loss resulting from faulty hardware, software or from data loss. Media Players and More is not responsible for data contents or the security of the data contents contained in any returned goods. Despite our workshop's strict  guidelines on not interfering with any customer data, data can be destroyed during our testing processes.
Backing up of data is the Customers responsibility and the Customer should back up any data prior to sending the goods back to us. Media Players and More does not provide a backup or data recovery service when sending back hard disks for warranty claims. Hard drives returned for manufacturer warranty are always replaced with a new or refurbished units at the sole discretion of the individual manufacturer.

Limitation of Liability
In all circumstances Media Players and More's maximum liability is limited to the purchase price of the product sold. Media Players and More shall not, under any circumstances, be liable upon a claim or action in contract, tort, indemnify or contribution, or other claims relating to the products it sells which exceed this liability limit. Media Players and More shall not be liable for third party claims for damages against the customer, or for malfunction, delays, interruption of service, loss of business, loss or damage to exemplary damages, whether or not Media Players and More is appraised of the possibility of such claims or damages.Specifications and model descriptions are subject to change without notice. Media Players and More does not accept any liability for errors or omissions (including typographical errors) or for manufacturer hardware or specification changes.

Force Majeure
Media Players and More shall not be liable for any delay in performing any of its obligations under these Terms and Conditions if such delay is caused by circumstances beyond the reasonable control of Media Players and More, and Media Players and More shall be entitled to a reasonable extension of time for the performance of such obligations.

Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of Queensland and shall be subject to the non-exclusive jurisdiction of the courts of Queensland. Any dispute with Media Players and More shall be brought by the Customer exclusively in the State or Federal courts situated in the State of Queensland.
 

Returns and Refunds

Media Players and More offers a 7 day return policy for products returned in their original, unopened and undamaged packaging except for those products sold on a "no return" basis. A refund will be issued for the original purchase price of the product, less any associated freight or postage costs, less a $25.00 administration fee. However we will waiver the restocking fee is another order is placed within 7 days with an equivalent or higher sales amount.

Where products are sold on a "no return" basis we will bring this to your attention via the website and/or sales invoice. Examples of products sold on a "no return" basis include non-standard, non-stocked, special orders, ex-demo, discontinued, auction and clearance products.

The "no return" basis means that, unless the product is dead on arrival, damaged in transit, incorrectly shipped or otherwise returnable under a manufacturer's warranty or by law, the product will not be accepted for return.

Any products being returned must be 100% complete and must be packaged in the original packaging with the Return Authority (RA) number clearly visible on the outside of the box in a manner that does not affect the saleability of the item. All packing materials, manuals, diskettes, CDs, digital media, blank warranty cards and other accessories and documentation must be included in the original packaging, as provided by the manufacturer. A return will not be processed, or a restocking fee of 20% may be charged in the event any item(s) included in the original shipment to you is not present in the returned package.

When sending a Return back to us we accept no responsibility for any loss or damage occurred during transit. We recommend that you register and insure your Return against loss or damage.

Please choose carefully. We do not normally give refunds if you simply change your mind, find a better price or make a wrong selection. You can choose between a refund, exchange or credit here goods are faulty, wrongly described, different from a sample shown to you or don't do what they are supposed to do.

We do not refund on postage just the same as a bricks and mortar shop does not refund your petrol.

We do not warrant that your purchased product(s) are compatible with any existing product(s) that you may already have. Customers are strongly advised to confirm the any compatibility with the original product manufacturer before making a purchase. Product incompatibility is not a fault.

Goods returned within the warranty period that are not repairable or have been discontinued or have become obsolete will be replaced with a similar model or given a refund for their current market value, due to the nature of the IT industry.

As per the ACCC guidelines for the refund of faulty goods within warranty periods, if the goods returned have had a fair amount of use, Media Players and More reserves the right to offer a partial refund or replacement only based on the remaining warranty period from the date of the sales invoice.

Media Players and More reserves the right to consider any warranty or refund items as seperate components if they were purchased as a bundle regardless of how they were invoiced or sold. e.g. If a media player develops a fault and the hard drive is working perfectly then we reserve the right to only refund the media player cost and not the hard drive and return the hard drive to the customer.
